Welcome to Origin Institute ("we," "our," or "us"), an integrated auxiliary of Bioharmony Collective, a 508(c)(1)(a) church incorporated in Colorado. These Terms and Conditions ("Terms") govern your access to and use of our website at theorigininstitute.com, our mobile application, and all related services, content, and features (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you
must not access or use our Services.

3. Eligibility and Age Requirements
Our Services are intended for users aged 13 years and older. If you are between 13 and 18 years of age, you may only use our Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. Users under 13 years of age are not permitted to use our Services.
By using our Services, you represent and warrant that you meet the eligibility requirements set forth above. If you are a parent or guardian permitting a minor to use the Services, you agree to be fully responsible for the minor's use of the Services and agree to these Terms on their behalf.

5.1 Free Trial
We offer a 10-day free trial for new users. During the trial period, you will have access to our Services without charge. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
5.2 Subscription Plans
We offer monthly and yearly subscription plans. The specific pricing and features of each plan are displayed on our website and within the app at the time of purchase.
5.3 Billing and Payment
By subscribing to our Services, you authorize us to charge your designated payment method on a recurring basis (monthly or yearly, depending on your chosen plan)
until you cancel. All payments are processed through our third-party payment processors, Authorize.net and Costco Merchant Services (powered by Elavon). Your use of these payment services is subject to their respective terms and conditions.
5.4 Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial subscription periods. Any fees paid prior to cancellation are non-refundable.
5.5 Price Changes
We reserve the right to modify subscription prices at any time. Price changes will be communicated to existing subscribers with at least 30 days' notice and will apply to the next billing cycle following the notice period.
6. Description of Services
Origin Institute provides educational content related to Qìgōng (氣功), traditional Chinese energy cultivation practices, meditation, and related wellness disciplines.
Our Services include:

7.3 Assumption of Risk
You acknowledge that participation in Qìgōng and other physical practices involves inherent risks, including but not limited to physical injury, muscle strain, fatigue, or exacerbation of pre-existing conditions. By using our Services, you voluntarily assume all such risks and agree to participate at your own risk.
7.4 Liability Waiver
As a condition of using our Services, you will be required to agree to a separate liability waiver. By agreeing to that waiver and these Terms, you release and hold harmless Origin Institute, Bioharmony Collective, and their officers, directors, employees, agents, instructors, and affiliates from any and all claims, liabilities, damages, costs, or expenses arising from your use of our Services or participation in any activities described therein.
7.5 Listen to Your Body
Always practice within your own limits and abilities. If you experience pain, dizziness, discomfort, or any adverse symptoms during practice, stop immediately and seek medical attention if necessary.

All content available through our Services, including but not limited to videos, text, graphics, logos, images, audio, course materials, and software (collectively, "Our Content"), is the property of Origin Institute or its licensors and is protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and stream Our Content solely for
your personal, non-commercial use. This license does not include the right to:

12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ORIGIN INSTITUTE, BIOHARMONY COLLECTIVE, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the Services shall be resolved through binding arbitration in Broward County, Florida, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
